RADIO COMPETITIONS: RULES, TERMS AND CONDITIONS

Welcome to the Competitions and Prizes for Radio Competitions T’s and C’s. The below has been created to give every radio listener a fair chance at winning, as well as to abide by South Africa’s Lotteries rules and regulations Act. These rules apply when Ultimate Media is the proxy on behalf of the radio station and/or client for prize management purposes.

1. Definitions

Unless the context provides otherwise, the words and expressions set out below will have the following meanings and cognate expressions shall have corresponding meanings:

1.1. “Competition” means any promotion, prize draw, giveaway or competition operated by Ultimate Media, including but not limited to those Competitions operated by Ultimate Media on behalf of the promoter or any Radio Station.

1.2. “Promotion” means the NAME OF PROMOTION starting on START DATE and ending at midnight on CLOSE DATE, organised by the Promoter and open to all people residing in South Africa.

1.3. “Closing Date” means midnight on the specified date.

1.4. “Promotion Period” means the period between START AND CLOSE DATES.

1.5. “Participant” means a person who enters the Promotion.

1.6. “Personal Information” means personal information as defined in POPIA;

1.7. “POPIA” means the Protection of Personal Information Act 4 of 2013;

1.8. “Process”/ “Processing” has the same meaning assigned thereto in POPIA;

1.9. “Rules” means these terms and conditions including specific terms and conditions; rules or entry instructions published on the Ultimate Media terms & conditions page (radiocompetitiontandc.co.za) or in any media which features a competition (e.g. on-air messages).

2. Application of Terms and Conditions

2.1. By choosing to enter the Promotion, the Participant agrees to be bound by the following terms and conditions, which the Participant acknowledges to have read and understood.

2.2. By participating, the Participants agree to comply with both the Promoter’s and the Radio Station’s Terms and Conditions.

3. Entry Requirements

3.1. In order to be eligible for Participation in this Promotion the Participant must:

  1. Be a South African citizen or permanent resident over the age of 18 (eighteen) years old.

3.2. Successfully enter the Promotion in accordance with the entry mechanism defined by the Radio Station via on-air communication, and social media, including WhatsApp.

3.2.1. Adhere to the terms and conditions that apply to this Competition.

3.3. Participants may only enter this Promotion in the Republic of South Africa.

3.4. WhatsApp Entry:

  1. To enter the competition, listeners need to send the relevant keyword to the WhatsApp number 066 050 6830.
  2. Standard data rates will apply – 20c per 20 seconds. Standard Data charges. SMS rates will apply. Free minutes do not apply.
  3. Entrants may only enter the promotion a maximum of 3 times per day and 168 times over the Promotion Period. An entry is based on the cell phone number used each time to enter through the journey.

3.5. The participating Radio Station and the Promoter will not be held responsible for any SMS charges, data charges, phone costs, or any other costs incurred while participating in this competition.

3.6. Participants who submit entries across multiple Radio Stations for the same competition will only be eligible to win through one Radio Station.

3.7. In cases where participants use multiple phone numbers or social media accounts to enter a competition, only one entry will be deemed valid.

3.8. For language-specific Radio Stations, finalists will be selected and screened to confirm their ability to speak the language used by that Radio Station before their names are submitted.

3.9. If a finalist cannot be reached for screening by the Radio Station and or Ultimate Media prior to or during the on-air competition segment or winner announcement, another participant will be randomly selected to take their place.

3.10. Finalists are required to keep their phones accessible before and during the on-air competition segment or winner announcement. If the Radio Station does not make contact, this confirms that the participant was not selected as the winner.

3.11. No entries submitted on behalf of a third party will be accepted.

3.12. Only entries received within the Promotion Period will be considered.

4. Prizes and Award Terms

4.1. In the event that the grand prize winner cannot be successfully contacted within 24 hours of the final decision or is unable, for any reason whatsoever, to accept the prize, a replacement winner will be randomly drawn from the remaining qualifying Participants in the draw in accordance with same process and procedures as applicable to the original draw.

4.2. Winners are only finalised once their names are announced on air.

4.3. Any prize not taken up for any reason within (90) ninety days of notification will be forfeited.

4.4. Prize fulfilment to be expected to be within (90) ninety days.

4.5. Winners will be notified should any unforeseen delays occur in the payment / delivery process.

4.6. In cases where an additional prize is awarded to a winner who is a customer or user of a client’s product, proof of such ownership or usage will be required.

4.7. No Third-Party Accounts: Prize money will not be paid into a friend, family member, or business account.

4.8. If eligibility for an additional prize requires that the winner hold a bank account with the client administering the competition:

  1. Winners will be required to supply proof of bank account. A certified copy of the official bank confirmation letter and / or verified bank statement – no older than 3 months. AND / OR physical address in writing, via SMS, WhatsApp, email, or social media platforms.

4.9. Should a winner submit incorrect banking or physical address details, they will bear full responsibility for any resulting loss of the prize.

5. Use of Personal Information

5.1. Personal information is information relating to a Participant. Personal information includes a Participant’s identity number, passport number and contact details.

5.2. By entering this Competition, a Participant agrees that the Promoter, Radio Station and Ultimate Media may use his/her personal information in connection with the Competition.

5.3. Processing of Personal Information

  1. By entering this competition, you voluntarily provide your personal information to Ultimate Media.
    1. Ultimate Media will process your personal information solely for the purposes of:
      1. Administering and managing the competition.
      2. Verifying eligibility;
      3. Contacting winners;
      4. Awarding and delivering prizes;
      5. Complying with legal and regulatory obligations.

5.4. Your personal information will not be used for any purpose other than those stated above. Information may be shared with authorised third-party operators (e.g., prize sponsors or courier providers) strictly for competition-related purposes and subject to appropriate security safeguards.

5.5. Your personal information will be retained only for as long as necessary to fulfil these purposes or as required by law.

5.6. By participating in this promotion, participants consent to the sharing of their personal information with the Radio Station, the Promoter, and their authorized agents for the sole purpose of facilitating prize fulfilment. This processing of personal information is conducted in accordance with the Protection of Personal Information Act, 2013 (POPIA).

5.7. As far as the law allows, each Participant agrees and gives the Promoter permission to collect, get, receive, record, organise, collate, store, update, use and share all his/her personal information for all purposes relating to the Competition.

5.8. A Participant may ask the Promoter at any time before the Closing Date to correct or confirm any personal information if it is wrong or out of date.

5.9. Each Participant warrants that he/she has the authority to allow the Promoter to use his/her personal information for purposes of the Competition. The Promoters will not use any Participant’s personal information in any way which breaks the law and undertakes to keep all personal information of Participants secure and for as long as the law requires.

5.10. Should the Participant Opt-In for further marketing communications then the following applies:

  1. Marketing consent is separate and optional.
  2. By entering this competition, you may choose to receive marketing communications from Ultimate Media.
  3. If you opt in, your personal information will be used to send you promotional material, special offers, and updates via email, SMS, or other electronic communication.
  4. You may withdraw your consent at any time by using the unsubscribe instructions via the platform that you used to subscribe via email, WhatsApp & SMS.

5.11. The Participant agrees that any photographs or videos taken of them in relation to this Competition become the property of the Promoter to use in any marketing campaigns as the Promoter deems fit. The Participant shall have no claim for any compensation for use of the photograph.

6. Warranties and Indemnities

6.1. The Promoter, its employees, officers, directors, agents and associates and the Participating Stores, their employees, officers, directors, agents and associates (the “Indemnified Parties’’) shall not be liable for and the Participants hereby indemnify and hold the Indemnified Parties harmless from any claim, liability, cost, expense or penalty suffered or incurred by any person as a result of participating in the Promotion.

6.2. All products given as part of the Prizes are subject to all applicable warranties, guarantees and instructions of use accompanying such products.

7. Force Majeure

7.1. In the event of any act of God, strike, war, warlike operation, rebellion, riot, civil commotion, lockout, combination of workmen, interference of trade unions, suspension of labour, fire, accident, or (without regard to the foregoing enumeration) of any circumstances arising or action taken beyond or outside the reasonable control of the Promoter preventing them from the performance of any obligation to a Participant (any such event hereinafter called “Force Majeure”) then the Promoter shall be relieved of all such obligations to the Participant during the period that such Force Majeure continues and shall not be liable for any delay or failure in the performance of any obligations or loss or damage which the Participant may suffer due to or resulting from the Force Majeure.

8. General

8.1. The Promoter, Radio Station may in its sole and absolute discretion amend these terms and conditions at any time, by publishing the revised terms and conditions on radiocompetitiontandc.co.za. or the Radio Station’s website.

8.2. The following persons may not enter the Promotion or be eligible to win any of the prizes:

  1. Any director, member, partner, owner, employee, agent of consultant to, or anyone associated with or affiliated to the Promoter, Radio Station or Ultimate Media.
  2. A supplier of Participating Products or services in connection with the Competition.

8.3. Prizes are not transferable for cash or any other prizes.

8.4. The Promoter will not accept responsibility for entries that are lost, mislaid, damaged, undelivered, or delayed in transit, regardless of cause, including, but not limited to, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

8.5. The Promoter reserves the right to disqualify any Participant who breaches any provision of these terms and conditions.

8.6. Finalists will be chosen according to what has been stipulated by the Radio Station, via on-air promos, on-air communication, and social media posts.

8.7. The decision of the Promoter and Radio Station is final, and no further correspondence will be entered into.

8.8. In the event of a dispute regarding any aspect of the Promotion and/or these terms and conditions, the Promoter’s decision will be binding, and final and no correspondence will be entered into.

8.9. In the event of a dispute regarding a winner chosen in accordance with 4.1 above, the decision of an independent admitted attorney duly appointed by the Promoter will be final and binding and no other correspondence will be entered into.

8.10. The Promoter reserves the right to cancel, suspend, amend, or terminate the Promotion at any time and without notice to the Participants.

8.11. Participants who have won a prize will only be eligible to enter or win another competition on the same radio station after a period of three (3) months or ninety (90) days.

8.12. Should a participant enter and win another competition on the same radio station before the completion of the three (3) month / ninety (90) day waiting period, the prize will be forfeited. The forfeited prize will be reallocated to another eligible participant in accordance with these rules.

8.13. The Promoter, Radio Station and Ultimate Media reserve the right to disqualify any entry or claim if fraud, dishonesty, or cheating of any nature is suspected on the part of a participant.

8.14. The Promoter, Radio Station and Ultimate Media reserve the right, in their sole discretion, to summarily disqualify a winner who, at any time, fails to act in accordance with the spirit of the promotional competition. A disqualified winner shall immediately forfeit any right, title, or interest in the prize.

8.15. The Radio Station and or Ultimate Media will contact winners directly to obtain their banking details and/or physical address to facilitate the delivery of prizes.

8.16. All Radio Competitions platforms must not be used for discrimination, abuse, or any fraudulent activity. Should participants encounter such issues, they are requested to contact Ultimate Media via direct message (DM) or email.

8.17. Should anyone be found to have committed the above, they will be blocked from all our online platforms and competitions.

8.18. All enquiries regarding the Promotion should be sent to competitionprizes@ultimatemedia.co.za.
